Success Fee

In Western countries, this form of payment has long been common, and it is becoming increasingly popular in Ukraine as well.

A success fee is an agreement between the parties under which the client undertakes to pay the advocate, as remuneration, a certain percentage of the monetary amount awarded to the client by the court if the decision is in the client’s favor. See the ECtHR case “Iatridis v. Greece.” In this case, the obligation to pay the fee depends on whether the advocate wins the case in court.

In case No. 904/4507/18, the Commercial Cassation Court within the Supreme Court defined this type of remuneration as the cost of services provided under a legal assistance agreement, in the form of a bonus dependent on the outcome of the case. When cooperating on such terms, both parties are interested not merely in the cooperation process itself but in its final result—a favorable outcome.

A success fee means that the client does not invest a large amount of money in the process upfront, but instead shares the case-related risks with the advocate.

An hourly rate may give the client the impression that the advocate is intentionally prolonging the process. A fixed fee, on the other hand, may lead the client to believe that the advocate is not sufficiently interested in resolving the dispute in the client’s favor, since the advocate receives the fee in any case, even if the case is unsuccessful.

Fixed Fee

Under the Rules of Advocate Ethics, a fee is a form of remuneration paid to an advocate for providing defense, representation, and other types of legal assistance to the client. The procedure for calculating the fee — whether as a fixed fee or an hourly fee — the grounds for changing the fee amount, the payment procedure, refund terms, and other conditions are determined in the legal assistance agreement.

In the course of the advocate’s work, the fee is formed based on actions that directly affect its amount, including:

  • reviewing the client’s available documents,
  • communicating with the client,
  • assessing the prospects of the case,
  • developing the strategy and tactics for conducting court proceedings,
  • studying the legal framework, case law, and resolutions of the Plenum of the Supreme Court on the matter in dispute,
  • consulting with specialists,
  • working with witnesses,
  • preparing procedural documents and advocates’ requests,
  • participating in court hearings, and other work.

After assessing the scope of the necessary work, the advocate will offer the client a fixed fee, the agreement on which will be recorded in the legal assistance agreement.

Hourly Fee

Hourly Fee

This is the most common form of payment for an advocate’s work. Hourly payment for an advocate’s services allows the client to save costs while receiving quality legal services.

The client pays only for the work actually performed, based on the time spent and the complexity of the case. The advocate includes the list of legal services provided and the number of working hours spent on them in a report, which the Bureau provides to the client, showing each item for which payment is made.

The hourly rate of the advocate may vary depending on the duration of the client’s use of the services as follows:

  • up to 10 hours — UAH 500/hour;
  • from 11 to 50 hours — UAH 400/hour;
  • from 51 hours — UAH 300/hour.
  • Oral consultation, up to 30 minutes — UAH 500.
  • Written consultation — UAH 1,000.

All client payments are made to the Bureau’s current bank account, which confirms the expenses incurred for legal assistance. If there is a signed agreement between the client and the advocate, as well as receipts confirming payment for legal assistance, the law allows the amounts paid by the client to the advocate to be recovered from the opposing party. Reimbursement of such expenses applies only to court representation and only when the court issues a decision in favor of the advocate and the client.
