Advocate’s Request

The Bureau’s advocates will professionally prepare and send an advocate’s request to an institution or organization, which can significantly facilitate and shorten the time needed to resolve the client’s dispute.

An advocate’s request is a written request by an advocate to a state authority, local self-government body, their officials and officers, enterprises, institutions, and organizations regardless of their form of ownership or subordination, and public associations, requesting information or copies of documents needed by the advocate to provide legal assistance to the client.

For the proper performance of a legal assistance agreement, our advocates will submit advocate’s requests, including requests for copies of documents, to state authorities, local self-government bodies, their officials and officers, enterprises, institutions, organizations, public associations, as well as to natural persons with the consent of such persons.

Advocate’s request

Only advocates may send advocate’s requests. An advocate’s request must be prepared in writing in paper form and signed personally by the advocate.

Our advocates may also prepare an advocate’s request within the framework of electronic court proceedings.

Under part 2 of Article 24 of the Law of Ukraine “On Advocacy and Advocate’s Activity,” a response to an advocate’s request must be provided to the advocate no later than five business days from the date of receipt of the request.

If any form of obstruction of the advocate’s lawful activity occurs, which may include failure to provide information and materials or copies thereof, late and/or incomplete provision of information or copies of documents, provision of inaccurate information, or other actions, the responsible officials, including the head of the enterprise, institution, or organization, may be brought to administrative liability under part 5 of Article 212-3 of the Code of Ukraine on Administrative Offenses, which entails a fine imposed on officials in an amount of up to fifty non-taxable minimum incomes of citizens, or to criminal liability under Article 397 of the Criminal Code of Ukraine, which is punishable by a fine from three hundred to five hundred non-taxable minimum incomes of citizens or restriction of liberty for a term of up to three years, with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.

The fee for an advocate’s request is 700 UAH for individuals and 3,000 UAH for legal entities.
